2. Overview
This website does not use cookies or analytics tools, and regular visits are not tracked. The only exception is the QR code in our letters, through which our information page also shows the facts from the letter (see section 4). The only form is the callback request on our information page about TYPO3 updates (see section 5). Personal data is processed only where necessary to technically provide the website, to evaluate this QR code and show the facts from our letter, to call you back at your request or to respond to an email that you send us.
3. Technical delivery and server logs
When you access the website, the hosting provider and participating network providers may process technically necessary connection data. This may include your IP address, date and time, requested file, amount of data transferred, referrer, browser and operating system.
The purpose is to provide the website securely and reliably and to prevent misuse. The legal basis is Article 6(1)(f) GDPR. Our legitimate interest is the secure operation of this website. Log data is retained only for as long as necessary for operation and security and is then deleted unless a legal retention obligation applies.
4. QR codes in our letters
Our letters may contain a QR code that leads to an address of the form binary-bay.com/l/<identifier>. The identifier is a randomly generated string of six characters. In our internal records it is assigned to the recipient of the letter, which makes it a personal identifier.
When you open the QR code, we store only the identifier and the time it was opened. From this we learn only that the letter was opened. This record contains no IP address and no browser or device data, and no cookies are set. You are then redirected to an information page about TYPO3 updates. The hosting provider's general connection data is processed as described in section 3, as with every page view. We do not link it to the identifier.
On the information page we show publicly visible facts about your own website that are also printed in our letter, such as the domain, the TYPO3 version and its size (for example the number of pages). We store these facts together with the identifier. The identifier is passed to the information page in the fragment of the address (the part after the # character). Browsers do not send this part to servers, so the identifier appears neither in the log of the page request nor in the referring-page information (referrer). To show the facts, the page retrieves them from our hosting at binary-bay.com/api/qr-facts/<identifier>. This request is processed like any page request as described in section 3. Beyond that, nothing is stored.
The record of the opening and the facts about your website are stored with our hosting provider, Netlify, in its EU region Frankfurt (eu-central-1). Section 7 applies to recipients and to any processing outside the European Economic Area.
The purpose is to see whether our letter was of interest, to follow up appropriately and to show you the facts from our letter on the information page. The legal basis is Article 6(1)(f) GDPR. Our legitimate interest is evaluating and continuing our business outreach. We keep the record of the opening only for as long as necessary for this purpose. The facts about your website are deleted automatically 90 days after the letter was sent.
You may object to this processing at any time under Article 21 GDPR by emailing office@binary-bay.com. We will then delete the data immediately. We keep only the identifier and the time of your objection, so that later scans of the QR code are no longer recorded and no facts are shown.
If you request a callback on the information page, section 5 also applies.
5. Callback request
On our information page about TYPO3 updates, you can request a callback. In doing so, we process your name, your telephone number, your message if you write one, the version of the page from which you sent the request (A or B) and the time of the request. If you opened the page via the QR code in our letter, its identifier (section 4) is also transmitted. This links your request to the recipient of that letter.
We use this data to call you back as requested. The legal basis is Article 6(1)(b) GDPR, as the processing takes place at your request in order to take steps prior to entering into a contract.
When the form is submitted, Netlify additionally records the IP address, browser identifier and referring page. These details serve to protect against abuse and spam. The legal basis is Article 6(1)(f) GDPR. Our legitimate interest is protecting the form against abuse.
Form submissions are processed and stored on our behalf by our hosting provider, Netlify (Netlify Forms). Section 7 applies to recipients and to any processing outside the European Economic Area.
We delete the data as soon as it is no longer needed to handle your request, unless a legal retention obligation applies.
6. Contact by email
If you contact us by email, we process the data you provide, particularly your email address, message and, where supplied, your name and company details.
We process this data to respond to your enquiry. The legal basis is Article 6(1)(b) GDPR where the enquiry concerns a contract or steps before entering into a contract, and otherwise Article 6(1)(f) GDPR. The data is deleted once the enquiry has been concluded unless a legal retention obligation applies.
7. Recipients and hosting
Data is available only to people and technical service providers who require it for operation, security or communication. Hosting providers may process data on our behalf. Where data is processed outside the European Economic Area, this takes place only on the basis of an adequacy decision or appropriate safeguards under the GDPR.
8. Cookies
This website does not set cookies. It does not require a consent banner and does not create marketing or analytics profiles.
9. Your rights
Subject to the GDPR, you have rights of access, rectification, erasure, restriction of processing and data portability. You may object to processing based on legitimate interests. Any consent may be withdrawn at any time for the future. To exercise your rights, email office@binary-bay.com.
10. Right to complain
You may lodge a complaint with a data protection supervisory authority. The competent authority includes the Office for Personal Data Protection of the Slovak Republic, Galvaniho 7/B, 821 04 Bratislava, Slovakia, dataprotection.gov.sk.
